Florida Statutes Chapter 893 titled “Drug Abuse Prevention and Control” encompasses the Florida Statutes known as the Florida Comprehensive Drug Abuse Prevention and Control Act. The Department of Law Enforcement, all State Agencies which regulate professions or institutions, and all Peace Officers of the State are required to enforce all provisions of Chapter 893 and shall cooperate with all agencies charged with the enforcement of the laws of the United States, this state, and all other states relating to controlled substances.
It is unlawful for any person to sell, manufacture, deliver, or possess with intent to sell, manufacture, or deliver a controlled substance, as defined by Chapter 893. A person who violates Chapter 893 can face sanctions ranging from a First Degree Misdemeanor up to and including a Felony of the First Degree (punishable by up to 30 years in Florida State Prison). Additionally, upon the conviction for sale and/or trafficking in a controlled substance or for conspiracy to sell or traffic in a controlled substance and if the offense is a felony, the Clerk of the Courts is required to send a certified copy of the Judgment of Conviction with a person’s license number, permit number, or certificate number on the face of the certified copy to the agency head by whom the convicted person has received a license, permit, or certificate to practice his or her profession or to carry on his or her business. The agency head shall then suspend or revoke the license, permit, or certificate of the convicted defendant to practice his or her profession or to carry on his or her business. This sanction itself, not to mention the fines, community hours, community control supervision, random drug screens, court costs, probation, counseling, county jail time and/or state prison incarceration, could have a devastating and substantial impact on anyone convicted of an offense set forth under Chapter 893.
